You circumvented software and hardware digital rights managment systems in order to install, what would be considered under Nintendo's TOS that you agreed to, unauthorized software on that hardware.
This, in Nintendo's eyes (who can hire lawyers that will shove yours into the dirt and spit on them), is equivalent to you breaking TOS and they are within their rights to ban you or otherwise brick the hardware.
This has nothing to do with copyright law.
