If your sysnand doesn't have pirated games installed, you can transfer no problem. You can even transfer edited, cheated save files (might get banned per game though)

You circumvented software and hardware digital rights managment systems in order to install, what would be considered under Nintendo's TOS that you agreed to, unauthorized software on that hardware.
This, in Nintendo's eyes (who can hire lawyers that will shove yours into the dirt and spit on them), is equivalent to you breaking TOS and they are within their rights to ban you or otherwise brick the hardware.

The switch let's you do that too. The only exception being Animal Crossing and (from what I hear) the Pokémon games. Everything else will still be present on the old system.
