Well I mean you can try, he pretends to go peacefully then the second the sheriff turns his back he pulls his gun and oneshots him in the back, then scolds you for being a little bitch and threatens you, walks out the door and disappears. You can't even kill him in reaction to him pulling the gun it's like fucking instantaneous, and if you shoot him before that everyone will aggro on you.
