Not quite. There's actually nothing illegal about selling an emulator so long as you don't use any proprietary software/hardware. If they wanna take donations for their work, technically, Nintendo can't stop them.

What actually gave Nintendo an in was that emulator devs have an extreme tendency to also distribute ROMs on the side. Nintendo has managed to gather evidence of this and this is what ultimatelly allowed them to shut them down. So emulator devs are very often retarded.

Japan's copyright law's make what Disney pushes for seem fair and reasonable. Copyrights last for 70 years and there's no fair use (but somehow there's shelves full of hentai parodies of current manga). Donkey Kong 1981 will be legally protected until 2051 and I'm willing to bet they'll alter the law to protect it even longer.

All of these laws can be completely ignored however, if you live in China and DGAF.
