That's why the lawyers for the Yuzu guys told them to pay Nintendo and settle, because Nintendo would be able to turn them into pirates who infringed on the copyrights of about 15,000 different pieces of software by creating software that circumvented the security measures that were in place to protect those copyrights.
Sure, as far as I know, you have the right to break a protection if it's the only way you can run your own software. So the guys could still try to fight Nintendo, but their lawyers probably figured there would be nothing to gain.

This. They have figured that encrypting EVERYTHING (including dock communications) is the gotcha to emulation law. The rationale being that emulation is fine but cracking their encryption keys is not and you cant have one without the other. This is the justification they used when going after switch 1 emulators but it was shaky because technically the emulators had you bring your own key files. The devs just got a little loose with how to obtain them in their discords. And of course no small fry dev is going to pony up to challenge them in court
