Increased resolution can trivially work for most part, but if the dev used low res polygons and textures, they can pop up and potentially "distort" the original experience. I personally wouldn't mind at all, but some people do.
The real issue is the framerate. If the code is "optimized" for 30fps and has physics and animations tied to it, unlocking it can introduce all types bugs.
Same reason why they don't dump the entirety of their first party catalog on NSO
They're drip feeding content to maintain interest
Nintendo withheld dev kits until launch for a lot of companies and upgrades can take a bit. Expect the roll out to begin next year.

I don't think Shiver was bought out to help big third parties to port their games, I think Nintendo bought them to do assistant work in Switch 2 updates

What I don't understand is why Third Parties aren't doing "Upgrade Packs". Yes, they'd require them to re-test their games in the updated patch, but they're bound to sell pretty well, as there's been plenty of decent third party ports for Switch 1, but the graphics settings are just so trash in them, that they weren't worth going for. Sega complaining their games didn't sell is so silly when they would've probably sold better by making Sonic X Shadow just an Upgrade pack, and Sonic Frontiers while they're at it, because those were already super good on Switch 1, but just super low res and blurry looking, and only 30fps. Nobody's gonna re-buy what they already owned at full price, when they likely already got their PS5 or PC port at a discount.
But an upgrade pack at 10 usd is fine.
Because Smash isn't just going to get resolution/framerate updates.

The same reason they drip feed their NSO roms at a snail's pace. It's to fill in the gaps when they don't have a big release, or to save an announcement for a direct. Most of them would be very easy to implement so they're going to spread them out over the life of the Switch 2. I'd expect to see another wave of announcements in a direct some time after DK Bananza.

Even then, a lot of Switch 2 patches for Switch 1 games has helped with the jaggies a lot, leading me to believe they're using a little bit of DLSS for anti-aliasing. It would smooth out some of the models, but they'd really need to upgrade the textures in a big way. Interestingly, Metroid Prime 4's Switch 2 edition is listed as having 4K textures. Now that's a newer game, we just don't know how Koei Tecmo is going to upgrade their older games. Seeing as how they're not an in-house Nintendo team it complicates things a bit. We haven't seen too many Switch 2 third party patches for older titles, only newer ones.

Can you no longer search games by developer on the eshop? You used to be able to click the developer's name at the top of the eshop listing to see all the games they've made
It really astounds me how few people in this "hobby" actually take the time to learn even a little bit about how the games they play are made. It's far more work than just "a couple lines of code." Even for minor upgrades like this.

Splat 3's free patch did more to change the game than Botw's paid Switch 2 editions. None of them are consistent in the changes they make. They could easily address any timing issue with actions with a patch, free or paid. They might charge money for it, they might not, but both can be addressed either way.
