It's not even capitalism, it's just the copyright experiment.
IP law doesn't work when applied to software and it doesn't work on the long timescales that were implemented so that legal cases could be stretched out for decades.
5-14 years for patents and copyright is optimal if you want to still keep IP law, while also throwing out trademarks entirely and just using tripcodes or something.
