GW has been extremely defensive of their properties ever since the Chapterhouse incident, which led to wide-scale company reform. The entire debacle of faction name changes and many rule revisions stems from GW essentially losing their case back when they used more generic terms. They now go an extra mile when it comes to legal, at least in keeping up appearances. It's the same as the WoW private server debacle from a few years back; Blizzard will send out hand-wavey "Cease and Desist" orders to show they're putting in effort, then never actually make moves against those servers because it's not actually worth the time. They can still gov"Oh well, we tried" and keep ownership without actually having to do much.
The big problem is TTS; they 'listened' to GW's notice which seemed to authenticate the threat which wasn't really there. The truth is that TTS was starting to get too large for itself and Alfabusa couldn't decide which way he wanted to go. The series ended right before the Fall Of Cadia arc started (notably; the Ynnead segment, one of the worst plots in 40k history) which would lead to Guilliman coming back. On top of the rapidly expanding cast, Alfa was getting stuck with bigger and bigger issues for a series that had been overtaken by memes even as he tried to make secondary sub-series to focus back on lore. Instead of dealing with the entire debacle, he called it quits before things could go wrong. GW just gave him a decent and timely excuse to bow out.
