For all I know except that one wings texture, everything else is just sampling, something that's been going on in music industry for a damn long time.
Then again, I don't know the actual difference between plagiarism and sampling (or homage for that matter). Usually I'll just wait until someone sues -- that means it's a plagiarism.

When you take a sound, that's sampling. When you take the entire melody section and re-use it wholesale, that's plagarism.
The line has become blurred in recent years with blatant plagarism being treated as somehow novel, just look at that blue knock-off song, but because everyone knows the original it's "fine". What Toby did is the opposite of fine, because he picked niche songs to rip-off on purpose, and tried to pass it off as original work instead of a remix.
