>>716066740>EULA allows a company to terminate the service so what's the problem here?In the EU service contracts are by legal definition for a set period, usually on the basis of monthly or yearly renewal.
And if the supplier terminates the service prematuraly, they are legally required to refund the last payment commensurate to the amount of time that was remaining on it at the time of termination. Contracts for digital content that do not define actual period, but leave it indefinite, are not service contracts.
Also - terms which have the object or effect of:
> making an agreement binding on the consumer whereas provision of services by the seller or supplier is subject to a condition whose realization depends on his own will alone;> -- (Annex 1c; Directive 1993/13) https://eur-lex.europa.eu/legal-content/EN/TXT/HTML/?uri=CELEX:31993L0013are to be considered as unfair terms of contract, which legally may not bind the consumer.

I don't get why private servers are such a big no no for these game companie. The vast majority of people will still buy the new game even if the old game works. Look at every sportsball game and every COD or Battlefield game. Even with complete dumpster fires like Civ VII the game still sold well even though every other Civ is still playable, although it failed to retain lots of players.
Is all this seething really just about not being able to ban people that say nigger from joining private servers?

Why are there shills for these ecelebs? Die.

>>716067065>Apple bent the knee to the EU and these publishers will toothis was unrelated to the sunsetting of a products lifespan and was about apple failing to notify customers of alternate payment systems other than the apple app store, which was actual wrongdoing on apple's part
>>716066740In short they cant put this in the contract without allowing user to terminate the contract on his part, otherwise it is an unfair contract. Since the payment is upfront the way the user could theoretically terminate from his side is inconclusive
>>716067510The simple answer is they cannot monetize community run servers and are deathly afraid of competing against their own products. How can you get people to buy new product and/or buy the battlepass if they have options?
Remember VHS killed the movie industry much like how SKG will kill the vidya industry.
>>716067108Maybe it's should be on pol as well, but it's also the most vidya of any thread. No thread is more about video games.
>>716067536I find it funny, isn't this sort of slander? I mean if your part of a movement like this I guess you're a public figure so maybe it's different rules?
>>716067510Imagine being a game production company. There's a huge backlog of old games people already bought they could be playing. Now imagine you could pull the plug on all those old games, and all of them were sunset. All those old school gamers would have to buy <latest thing>. That's the dream world they want to create.
>>716067359Its even more moronic if know that Ross adamantly denied any ideas of asking for donations to run the campaign
The corpo lobby and shills are really scraping the bottom of the barrel to try stopping it
>>716066620This
Clinton-style suicides are too memed now, everyone knows what it means when someone working against (((them))) suddenly kills themselves, even with a 'i am not gonna kill myself' notice
>>716067510Planned obsolescence for one thing. If they can kill their old games you will have to buy their new games instead. Then there is also just forcing the devs to have to plan for something they have been lazy about in the past. Probably plenty of other reason they don't like this.
Are gamers the most braindead cattle on the planet? You can trick them into signing anything as long as you tell them it will make their toys better.
>>716067510>I don't get why private servers are such a big no no for these game companie.more people playing the old game on private servers mean less people buying the next entry in the franchise
it was never a tech problem, it was always a money and greed problem. Also publishers are just retarded across the board

>>716067608I was talking about the USB-C charging port

>>716067510Remember when they pushed really hard for steaming services and always online functionality? Why? Shareholder Primacy.
>>716066740>did they break a lawthey're exploiting a grey area because they are like little kids would have to be explicitly told not to be twats

>>716067510Private servers means you cant directly ban wrong think on every server or even god forbid players could mod it to play in the different way people want it to
We joke but yes the lobby really pulled the "Um think about the unsafe gaming practices that could soil the brand, sweety" card on the last time they made a message. Not every company is like Valve who doesnt give a shit if your private tf2 server has al quaeda terrorist demo addons
>>716067359its even funnier when their own laws say this is fine
>>716067970>it's not an unfair contract because you aren't being forced to sign itNot how it works in the EU.
>>716067660Well, he's not part of the actual initiative "Stop Destroying Videogames", his name isn't anywhere in the legal documents, he isn't even a EU citizen. The "Stop Killing Games" is not the official name of the initiative, it's a non-profit movement to promote the real thing. He acts as a volunteer and start it by finding all the right people to make the official initiative, and those people are the ones who do all the legal work, he merely spreads awareness.
>>716067920We need to find out who sent this. Seriously. If this is a videogame publishers they are done. Read principle 7. Or let me just cite the relevant passage for you:
> Consumers that are willing to spend excessive amounts of money on and in a video game, so called โwhalesโ,may be considered vulnerable since they are likely to struggle with impulse control or gambling disorders.
Consequently, video games that base their business model on targeting โwhalesโ are likely to target a
vulnerable group of consumers. Therefore, the fairness of their commercial practices is to be assessed
according to a stricter threshold.
The EU is *already* gunning to have lootboxes and all exploitative practices labeled as distorting economic behavior, and thus classified as unfair commercial practices under the 2005/29 Directive.

>>716068824>ok so what's the problem then? is this just about bringing that over to the US?Enforcing it honestly. EU legislations are full of these holes where something is illegal but nothing is done(or can be done) about it. E.g. one of the most retarded laws in my country is โprohibition of smoking in public spacesโ. Not that the idea is bad, but there is no actual legal definition for โpublic spacesโ and as such you cant be really fined. Another good one is that now everyone under 16 is required to wear a helmet to drive an electric scooter, but everyone under 17 cannot be fined and fine expiration date is 1 year. Same here, the contract is illegal and technically void, but neither steam nor ubishit launcher will refund you the crew 1 and to get them to do so youโll probably need to waste hundreds of thousands on legal actions before you get your 100 bux back. There were a case a year or two ago where someone forced a refund after the ban but as far as I remember it was some whale that poured thousands of euro into the game.
>sounds like a french govt problem>I don't buy ubishit and neither should anybody else. problem solvedThe problem is that voting with your wallet is supposed to be a market controling behaviour that doesnโt control the market. You dont purchase ubishit, I dont purchase ubishit, but some people do and they actively beg for gibs from the government if money they earn is not enough, so their shitty practices stay in the market. Everyone else sees this and asks themselves โwhy dont we do the same shitโ, so in the end you get a free market full of trash instead of quality products.
>uh i didn't realize they could shut down the servers some day

>>716070391they hate things that cost them money
>>716070241yes but nothing in the initiative forces sharing server code
it asks for something- anything, that makes the game playable, sharing code is literally the last resort option or if the guys making the game are generous and able to do so
How many games do you think have source code releases? It took 2 decades for EA to let go of C&C's source code. iD Software was ahead of the curve and had Carmack release both Quake and Doom's source code a few years after the fact. But not everybody does that or needs to do that.
Point is
>>716070242Even if a game can have hosted servers BEFORE the end of life, they will still be playable. You could play WoW Cataclysm private servers during Cataclysm's lifespan yet the game retained a sizable playerbase that didn't translate into Pserver players.

It is why when they acted, their demands were instantly met, whereas regular people in the EU need to wait a year and gather a million signatures. These two are not the same.
