Because of the way the Geneva Conventions are worded. It is not illegal to bomb schools, hospitals, etc if they're being used to house enemies or weapons. It IS illegal to hide among civilians for the purpose of waging war. It was explicitly done this way because they knew if it were the other way around every army would use civilians for human shields. All Israel has to say is "whoops we had intel that there were Hamas soldiers/weapons" and it's all good.
