All games were sold as licenses, even before digital distribution became the thing to do. You technically weren't supposed to be reselling discs, but it was just completely unenforceable that nobody bothered trying to do anything about it until network infrastructure got advanced enough that games could be distributed mostly or entirely digitally.

All that said, GoG telling you not to transfer games is completely unenforceable in the same way, the installers are DRM free, you can burn them onto discs and give them to whoever you want. That's in there to cover their own asses if angry lawyers come calling.

That's true, not denying it, but I feel it needs to be clarified that this is how licensing always worked. The advent and propagation of network infrastructure just made it easier to control. Of all the distributors out there, GoG is by far the most benign, if they cared about enforceability, they would have implemented harder DRM, and they haven't. Even Steam's DRM is pretty easy to defeat, almost by design I suspect.

No, he's correct, you don't own the "game" as such, you own the storage medium it's on, and that's what you're allowed to transfer and resell. A lot of people get that mixed up. Digital infrastructure removes the storage medium from the equation in a technical sense. Strictly speaking, once you download the game on your gaming system of choice, there is absolutely no legal tape in the way preventing other people from playing the game on your system, thereby "transferring" the storage medium. They try to get around it with accounts and DRM, but they can't really stop you from letting other people play games on your system if they come round your house.

It's not what Steam users forfeited, it's what we accepted, and that was DRM. Copy protection is inherently intended to prevent you from transfer the storage medium that contains the game, and thus the license.

Console users aren't exempt from this by the way, but the console ecosystem definitely lasted longer. It's over now since what you buy is usually a disc with part of the game on it (sometimes not even that) and a one-use activation code that ties the game to your non-transferable account.
