Based on what I've read, it sounds like two annoying people have lost out. Billy Mitchell is a charlatan and an unequivocal vexatious litigant, meanwhile Jobst's constant crusades against Mitchell and insistence he is on some moral crusade are cringe-inducing at the best of times. Jobst absolutely should not have been able to escape having to pay for Mitchell's legal fees in the way that he did, and the fact he can do so is an extreme injustice.
