You can prove someone is stream sniping, but about 80% of the time it's an innocent person getting banned because there is no regulations for streamers and corporations are naturally going to side with the streamer because that makes them more money which also should be regulated.

Fortnite has had, for at least 5 years now, a streamer setting that adds a random delay between selecting to queue and being put into the queue, so stream snipers can't coordinate with your Twitch stream to get in the same match as you. They also have an Anonymous mode that hides your username during a match to make it harder to tell if you succeeded and getting in the same match as them. Any streamer who gets sniped is the one at fault for not using these tools.
