Grave robbing is grave robbing in TES. They dont make it very clear, but people still use the burial tombs in some places. In morrowind you are 100% graverobbing if you take from an ancestral tomb.

that's what i mean, there are actual legit graves in oblivion and it would be and is in some quests considered grave robbing, and is a crime

but all the items in all the tombs aren't marked as stolen, you are often given quests to go into them and recover items, they are completely defunct and hidden out in the unclaimed wilds and there are very rarely people actually directly related to the undead in the tombs, and even in morrowind there are even dunmer cultures that explicitly believe in a "winner takes all" mindset and they themselves keep their undead ancestors awake and standing guard over their own grave, so if you go in there and you fight them and win it's rightfully your shit anyway

you know where it IS actually also grave robbing? in the undercrofts of chapels and temples, that stuff is usually all considered stealing in skyrim, oblivion, maybe some places in morrowind
