Modern first world societies are built on trust to a certain extent. If you had to check the fine print every time you buy something and society was okay with people getting dicked over easily if they don't, there would be a chilling effect. That stifles consumerism, which is bad for the entire economy.
You can have your society where companies can put almost anything in their contract and it's always the customer's fault if they get dicked over, but you'll get outcompeted by societies with negotiated guard rails.
