There are examples of games that satisfy SKG like COD 4, AOE2, Counterstrike, that allow players to create their own servers without need or access to proprietary binaries, or simply use alternative methods like P2P.

They pass "Directives" which are simply just "the EU decided to make this a goal" and then every member state is tasked with passing a national law to follow that goal.

The EU has too many members with VASTLY different legal systems, making one law be dictated from the top is an easy way to make this impossible to implement due to legal compatibility issues.

Yes every EU member will try to make their laws as similar to each other as possible, but it's generally the fine detail that needs fine-tuning for every member country's legal environment.
