No one is tracking direct downloads, that would have to be your ISP, who doesn't care, or the distributor, who also doesn't care unless it's a honeypot, and no one is maintaining a honeypot for DDLs.
It's also a lot harder to prosecute for DDLs. With torrents they can just passively monitor traffic and inform your ISP and press charges for illegal distribution. No one who ever got sued back in the Napster days went down for downloading, they got hit for unauthorized distribution of copyrighted material.
