No, but in the context of this particular character you can. Also TM is normally prohibitive compared to the R with the circle. They're probably just trying to claim ownership of it so they can smack anyone making a similar character, moreso than that string. This time it passes the sniff test imo.

Yes, because the trademark isn't simply a word combination. The font used, colors, the design of the "o" as a flower, that's what is actually trademarked.
