Yes you need to consume them to gain stats. Alternatively you can sell them at the start and level up the regular way with the souls you get.

Uninstall/remove Lolita.ttf from the game files. Unfortunately you're still stuck with some kerning issues after its removal, and the font size itself is like 2 points smaller for some fucking reason. It's not too much of an issue unless you're a stickler like me though.

To be more specific, rape will break companion questlines for hopefully obvious reasons. You'll have more of a reason to fill the rapedex in the second game.
