Back in the day people, espescially parents, would call any videogame system “a nintendo” even if it was an atari or whatever. That’s what the ad is talking about.

They tried very, very hard to get game rentals shut down in the late 80s-early 90s too. Then a couple years later they were deepthroating the politicians going after violent vidya by playing up their family friendly image and pointing fingers at Sega and other companies, hoping it would hurt them. They've always been an abhorrent company.

NTA, but I was born in 1989 and my parents and their families never had Atari. The NES was the first video game console they ever had and everyone called it a Nintendo, even my aunts, uncles, and grandparents. Everyone in my family continued to use "Nintendo" as a stand-in for any console game for decades after. It ended up resulting in some weird-sounding exchanges when we owned both a PlayStation and an Xbox, like:
>I'm going to go play Nintendo.
>Which one?
>The Xbox.
Or:
>Anon is playing Nintendo on the PlayStation.

The context for this is that in the land of the free, if a product name becomes a common word the company risks losing all the rights to that product's name and everybody would be free to use it, unless said company proves that it fought to retain its rights.

They don't care that soccer moms call everything a Nintendo, on the contrary that's free advertising, this ad isn't for them, it's for the courts.

Such is the law in the land of the free.

I've never heard that one before but the reasoning why it would have suddenly fallen out of favor where something like Band-Aid wouldn't is simply that it's not a mass market product like Coke. It was a very niche product that was used in specific sectors by the time it became mass market any branding that would have applied to it is gone.

It's a copyright thing. Asprin is a brand name but it's also the generic term for any pain killer so any company can make their own pain killer product and call it Asprin.
The NES or just "Nintendo" by the mid to late 80's was quickly becoming the default term for all video games, Nintendo feared this, they didn't want Atari and others releasing their own Atari Nintendos and has things like >>12090934 (OP) and the Nintendo Seal of Quality to reinforce the branding.

There's Mario Madness. There's Mario Madness: Super Mario Bros. 2. But there's no such thing as Super Mario Bros. 2. You see, "Super Mario Bros. 2" is a subtitle, not a title. It is a descriptor that identifies the high quality product marketed and licensed as "Mario Madness". So please use our subtitle carefully. And never use it to generically describe the second game in the Super Mario franchise.

They got scared by the Band-Aid versus Adhesive Medical Strip legalities.

Under US Copyright Law you can't copyright a commonly used term, like "game." This has come up in legal discussions about copyright when a copyrighted name becomes commonplace, like using Band-Aid for band-aids even though Band-Aid is copyright of the Johnson & Johnson company and the generic name is "Adhesive Medical Strip."

Nintendo was worried when people were calling the Sega Master System and Turbo-Graphix 16 a "Nintendo" that they could lose the copyright on their own name in the US.

Silly, didn't happen and probably would never have happened, but it's a CYOA (cover your own ass) just in case.

The fart huffing marketing man insisted it is not a noun at all
>any other company's Entertainment System.
Nobody has ever called anything entertainment system, and said text also indicates that Nintendo trademarked the full name "Nintendo Entertainment System"\ so to act like "entertainment system" let alone "power" is just a product type like "game software" is absurdity.

This is just a branding thing that marketers loved to do back then, to claim that a brand name directly means some sort of value rather than it merely being an association of company's business activities.
