They'll mention something like "play online with your friends with our NEW MEGABUSSY NETCODE". It is in fact new and it exists. You'll have to make a case that netcode implementation is actually dysfunctional. And considering how class actions payouts are structured, you probably don't want to jump through all the legal hoops unless you're a class action lawyer and considerably confident in the payout.
