They do, but the non-compete only means they cannot join another agency which does any sort of business in Japan, for some set period of time - presumably one year, based on the time between Coco's graduation from Hololive and Kson joining Vshojo; but definitely not longer than that.
"Doing business in Japan" doesn't just mean they can't join Japanese vtuber agencies like Niji or any of Brave's agencies, but also overseas agencies which do any sort of business in Japan at all, such as "allowing viewers with Japanese IP addresses watch streams and vods" or "allowing customers with cards issued by Japanese banks to buy official merch" or "allowing people physically living in Japan to officially join the agency as vtubers." That last one is why US-based Vshojo needed to wait as long as they did before they could hire Japan resident Kson.

Yes, Saba lives in the US, where non-compete clauses are not worth the paper they're printed on. But Cover is based in Japan, where their non-compete clause is valid and enforceable; and non-JP agencies which intend to do or are doing business in Japan would be wary of hiring her (assuming she ever had plans of joining any other agency in the first place)

if there's one thing i know about japanese culture (and this is an offshoot of that), everything they publish is extremely malicious, and detrimental to all that consume it.

Also something that >>101842471 pointed out - Saba's presumably living in USA, Cover is Japanese company. The sheer cost and length of this purely theoretical legal case makes it just not worth it. There's American branch of Cover but they were mainly created to deal with merch production and distribution so it's questionable if they have tools and resources for this kind of stuff.

You Americans are so trigger-happy for calling to sue someone but absolutely don't understand that this is not some magical kill switch for every minor issue. Especially in this case it's just not worth it.
