It's kind of a delicate balancing act. They theoretically could break NDA all they want now. The company's all but finished, and if they DID go after the talents for breaking NDA they would only be even more finished than they already are and would be demonized forfuckingever.

On the other hand, for a crazy enough motherfucker that could be viewed as a way out. With nothing left to lose, why not sue a talent over breach of NDA to try and scrape away some cash before you vanish into the darkness? While I'd like to believe Gun or the top people at VShojo wouldn't view things that way, I can't fucking say for sure and I doubt anyone else can so it's not worth risking it. Vei mentioned waiting about a month because yeah by that point things will likely have progressed enough that they probably couldn't sue even if they wanted lol.

I don't think Nyan and Silver joined Mythic just so casually after leaving. We know, Mouse and Zen were also approached.
I think when Vei joined (and Mouse joined the UTA), they realized the potential of double handling an agency, think about it: less work, more profit. I think Vei in her contract was pushed like Lily to have more profits from Mythic to be taken from her, which didn't sit well with Vei. Nyan and Silver who had been recently having issues with VShojo itself, were also thinking of either going with one or double handling the two, but once they heard about Vei, and likely VShojo also did the same to them, they left.
The other girls were not affected, even Mouse, which probably did win the renegotiation and saved herself which is likely where also Silver was probably mad at her.
