Well at least Mayday had something like that in her series. I need to read it but I just saw an image of such a thing existing. Don't know how much it matters. But I'd definitely buy some merch of Mayday or that bimbo space version that Jimmy made in that one issue.
Also holy fuck how has Peter not hired or asked Daredevil for help in getting Spider-Man some money from merch made from his costume? Seems like a great storyline. Peter acts as Spider-Man while somebody else uses Chameleon tech to look like Peter and they both appear with Matt in court to argue for a way in which Spider-Man can profit from his trademark or likeness. Matt arguing against a bunch of shops or companies that have gotten away with marketing superheroes.
I dunno the actual legality of a masked hero like Spider-Man would work to protect their masked persona but I put this in the google A.I. and this what it said:
Right of publicity
This is the right to control the commercial use of your name, likeness, or other aspects of your identity. While it is most often associated with celebrities, everyone has a right to prevent their identity from being used without permission to sell products or services.
Applying it to a masked identity: For a masked person to sue under this right, their disguised persona must be a recognizable and marketable identity. The person would have to prove that their specific masked character was exploited for commercial gain without their consent.
The suit's focus: The lawsuit would protect the persona itself, not the hidden individual behind it. The plaintiff would be suing to protect the economic value of their public-facing, masked identity.
So yeah I dunno if that is right. But MJ should alongside Peter and Matt argue for superheroes to retain their personas to use for commercial gain. But nah we gotta have Peter constantly destitute.
