Yes because he has a lawsuit settlement that lets him use Sonic characters as long as they're rooted in his writing and distinct visually from how SEGA presents these characters. As long as it isn't mistakable for a SEGA product. It's legally allowed. Since SEGA has retired the iconic classic western Sonic artstyle, Ken Penders is allowed to do this as long as SEGA continues to neglect that artstyle.

No but Sega isn't going to do shit. The settlement gave Penders only the ability to use character names and vague similarities. They can't even look like Sonic characters which is why the characters in the Lara-Su Chronicles look so weird and different. But Penders has been testing the waters to see if Sega will do anything and they haven't so he's been getting more bold.
