This is quite literally why all consoles and apple take FreeBSD as their base, this is a quite modern OS that works reasonably well, but has the plus of the BSD license, which basically means that they can take the kernel, develop their OS around it, do all improvements they need and have no obligation to release the improvements back to the original kernel.
If all of those corporations released the drivers and overall improvements back into freeBSD, it would most probably be a massively better OS than linux, but they specifically use it so they don't have to, unlike with linux.
