A c# app in WinUI 3 is slower than a c# app in WinUI 2. Decoupling WinUI from windows meant losing optimizations, and I don't know if they'll ever make up the lost performance. Probably not with where things are going.

yeah, that's the problem. DMCA is incredibly vague, and rightsholders (eg ms) can sue for any reason and no fucking reason at all. Hosts don't want to get into a legal battle, so they'll take down pretty much anything if someone with deep enough pockets asks. Hence you have to make sure not to piss off said rightsholders. See for comparison what happened with the yuzu/ryujinx stuff. There was no real question about legality, and no actual legal battle either, but hosts folded like soggy playing cards anyways.
