It's real but unrelated to the UK law. Nvidia has been doing it for years now. If you enter a birthday that's too young you get locked out of their software and have to contact support or reinstall to fix it.

if they in fact doing that I'm pretty sure it implies they are gathering user information much and much more of it than merely telemetry on pc hardware information
