Your face is classified by the GDPR as in the 'special categories' of personal data, being that it allows establishing gender and ethnicity.
This means X cannot process it legally in the EU for the purpose of age verification.
The 'special categories' are forbidden to be processed in general, save for a small list of limited exemptions.
Two of those apply: direct consent for processing; and serving a public interest based in law.
Consent cannot be used, as it has to be freely given and free of negative consequence if you refuse. Denying access to certain content if you choose not to, is a negative consequence which means consent cannot be freely given. So this exemption is out.
The public interest based in law here would be Art 28 of the DSA regarding protection of minors online.
However, that article in its third paragraph explicitly states there shall be no obligation to verify age using means that require collection of additional personal data. As X's solution processes a picture of your face, which is personal data, the third paragraph kicks in. Thus there is no public interest based in law either.
Bottom-line: X is forcing this on the EU in violation of the GDPR and Elon can start looking forward to yet another billion-dollar fine.
