Stop claiming this.
The copyright owner has the right to control derivative works.
Linus and all the rest of the copyright holders of linux want changes to be redistributed.
Grsecurity never paid linus or anyone else anything.
Linus and everyone else can rescind GRsecurity's permission to use linux to make derivative works at _ANY_ time.

Yes this would cause a copyright exploratory suit. No Grsecurity wouldn't win it.
Yes it would cost "Linux" 1 million dollars to go through the courts with it.

2): Grsecurity is also violating article 2 section 6 of the GPLv2. Which is, in and of itself, a copyright violation.

Linus and the rest can go after them for that. In their "access agreement" they make the "subscriber" promise not to redistribute the derivative work.

This is a restriction placed on the "subscriber" that is not present in the GPL, and is also at cross-purpouses to both the GPL and the intention of Linus and the linux copyright holders in their use of the GPL as their license memorandum:
They made clear they wanted all changes to return to them.
