If a slave master legitimized one of their children they could inherit the family farm and it seems ~.06% of masters were of this class. Most of them in New Orleans

A "free black" is a misnomer. It is like a mule that nobody currently has a claim over, liable to be claimed and put to work by anyone at any time.

Slavery was not "race based" by law.
All slaves happened to be black because the only places that still sold people as slaves in theseera were in Africa.
But being black did not automatically mean being a slave.

It was in fact race based, you couldn't enslave non-black people. There are occurrences where free black people were kidnapped and enslaved, this could never have happened to a white person. Also the vast majority of black people in America were slaves at the time.
