actually insane the founding fathers were as grounded as they were, even for their time, to devise a court system based on playing devil's advocate and shielding against mob rule. If the constitution were written today from scratch you'd see nothing resembling that sort of grace
It's even wilder when you know guys like Sam Adams, Charles Lee and Benjamin Rush during the war were the equivalent of Robespierre and the gang (minus the guillotine obviously) while John wrote a Constitution for Mass. that was almost a complete copy of the pre-revolution one of the British governor-general system. Pennsylvania tried going full "true Whig" under the cloak of democracy while disenfranchising 4/5ths of their male population and it backfired spectacularly.
