Actually, I believe you could always be copyright claimed by any IP holder for the crime of using their characters in your artwork. Most just don't do that because it's free advertising and it'd be bad publicity to punish devoted fans, on top of wasting money to take down something that's likely not all that damaging to their brand.

In the case of Uma Musume, it's actually less the company that's worried about porn, and more the Horse's Owners (the characters are based on real life horses) who feel weird about it, thus the company is acting on the Horse Owner's behalf and taking down any porn.
