There's no penalty for catching hostile humans, but a lot of friendly ones will count as assault if you attack and trigger PIDF to attack you.
There's no downsides to having humans. At first, they only had Handiwork as a base skill, but now they have access to nearly every skill (depending on the type) and you can have a fully functional base with only humans. A benefit is that humans keep their interactions when you speak to them, so if you capture a merchant of any type, their shop is always available. Personally, I always catch the Wandering Merchant that visits your base early on, he essentially just a free capture since attacking him doesn't count as a crime.
Oh, and humans can use skill fruits, so if you wanted your merchant to fire his lazor, he can do that.
