If a unit is charged in the flank, is the enemy unit which charged them within their line of sight?

Item requires enemy unit to see the bearer in order to take effect.

Line of sight is usually 90 degrees from the front but when you are fighting on your flank, the unit defending can clearly "see" the model carrying it, hence fighting.
