It could go either way. But first the rule would need to be implemented by the administrative state with a notice and comment period before it winds its way though the administrative law process. It will be a ban on sale by the ATF and the DOJ will figure out some scheme to enforce it. The death of Chevron makes appealing this much easier but it will take years before it goes up to the Court. Thanks to the recent ruling on injunctions it will be the law de facto for that time. You could make the argument it is an ex post facto law which could speed things up but that is doubtful.
