Is he human? Are kryptonians supposed to be of the human species? Also, being human doesn't mean much if you're a superior being or a superior species. Same way us humans step on cockroaches. We are cockroaches to superman if he's not human.

His speech against Lex at the end was so unnecessary, everything in the movie already proved the point he was making
