Jojo has a lot of rules, but it's not about the rules. The rules are ultimately just for fun and just in service of the fights. Araki is fundamentally not a nerd/geek who cares about shit like rules, powerlevels, consistency, plotholes, etc. He just wants to draw beautiful men and think of weird outfits. He's not a weeaboo who is into muh worldbuilding he is an artist and a westaboo.

I thought the explanation was that JoJo has an afterlife, and you can't retrieve a person's soul from it once they're in it, hence why people can't be brought back from the dead. But Hayato was fixed almost instantly, meaning that his soul never crossed into the portal guarded by the pink-haired ghost girl in the ally-way
