If it is a singular event, like a stabbing or whatever, with no gefencing currently in place, the police are required to have the phone and phone number and a court court order for that exact phone to see if it was in the area.
Which means they have to have a suspect in custody, and a reasonable enough belief to convince a judge to issue the subpoena for the tracking.
