if i remember correctly this resturaunt was away from their usual spot and i think they payed with cash and i would imagine everyone inside knew they were in the mafia. thats probably why he went out there alone, he was probably telling the other waiters im gonna go out and say something and they all must of told him not to make a big deal out of it and let it go. when the police came to talk to the others they all probably were afraid to speak about it or if they did what are they gonna say, they were a bunch of itallian guys in suits. maybe the police knew or suspected it was Tonys crew but he had some of them paid off and without witnesses of the crime or evidence, nothing would stick in court so it would be better to let it go
