As far as I know, in the US you can break protection if it's the only way you can access your own copy of the software. So if you have a mig switch to use your own game, and the original game broke or something, and Nintendo blocks you, then Nintendo is infringing on your rights and you can sue them and win, but you'll spend more money in court than you'll gain from having a $500 console banned.

Note: It's cool that with 85% of physical games actually being digital, if your console gets banned for any reason, you basically lose access to your entire game library.

The mig loader is only for switch 1 games. Also mig loaders arent modding consoles it just tricks the console into thinking you have the real cart in.
