As far as I know, in the US you can break protection if it's the only way you can access your own copy of the software. So if you have a mig switch to use your own game, and the original game broke or something, and Nintendo blocks you, then Nintendo is infringing on your rights and you can sue them and win, but you'll spend more money in court than you'll gain from having a $500 console banned.

Note: It's cool that with 85% of physical games actually being digital, if your console gets banned for any reason, you basically lose access to your entire game library.

The mig loader is only for switch 1 games. Also mig loaders arent modding consoles it just tricks the console into thinking you have the real cart in. It's pretty much the only way to play pirated games on a switch 1 on any hardware post exploit fix, and playing online with a mig loader was always a crapshoot because they would go through occasional ban waves.
Mig loaders for switch 2 games will eventually exist, but this is the consequence you'll have to deal with, along with future Nintendo releases likely being incompatible and it requiring getting a new cart every once in a while, all the while your switch 2 is stuck offline with no way to ever update it.
