A good start would be to ask for a copyright and DCMA exemption for single player games that are abandoned and in a "vulnerable state".
Basically if the game only exists on CD-ROM or floppies or have a DRM that require an server that can be shut down, it should be legal to crack and replicate it.

To tie it back into gaming — if the game is being sold to an individual, the individual should have access to it as he becomes the owner of his copy of the game. And any features that were advertised as part of said sale should be readily available — to an extent.
A better example would be if a house was sold and the previous owner somehow activated a kill switch to prevent the home from ever having earthquake insurance ever again. The new owner is responsible for insuring his home, but the resources to do so are available. This may require additional costs, but there is a clear path available if he wants to maintain his insurance.
Video games that rely on central servers generally make the whole of the game unavailable and do not provide any route to restoring it to a playable state.
