So you want the state to force the publisher to transfer the server binaries into public domain or something similar on a date known in advance.
Nevermind that the initiative already states that there should be no IP changes.
This is dishonesty/stupidity, on top of limiting the free market. Do you see yet why you're actually commies?

Just let them have their gay little petition, hiding inside away from the mass invasion of black as night gorilla niggers directly from africa and islamofascist rape rats is all they can do.

The definition of evil is placing one's personal gains above everyone else's wellbeing.
So- yes.

If you're against this ECI and against the EU evaluating the balance between consumer rights and businesses' interests, and are against both being given fair opportunity to plead their case as such, then you are either an industry plant operating in your employer's direct interests for monetary gain - i.e. are evil.
Or you are an idiot that actually doesn't understand how these ECIs work.

Pick.

Europoor value the things they buy much more than us Amerifats, because they are extremely poor.

Reminder that in most of europe the EFFECTIVE tax rate is near 50%, after income, vat, regional taxes, and etc.

Combined with rather low wages, this means that Europoors have VERY low spending power compared to us golems. We can just buy random shit all the time and we don't care, throwing money away on nonsense. A europoor must carefully analyze every purchase he makes for maximum benefit both short term and long term, so it is understandable that he would be extremely angry if he loses access to something he thinks he owns a couple years down the line.

You would never understand the mentality until you experience life as a europoor, where 50 euros (I don't even have the symbol on my keyboard, that is how irrelevant they are) is a make or break amount of money.

Those still have EULAs, and publishers _are_ alive.
Gabe snorts all the coke in the world, Valve and Steam disappear, you're downloading the old CS dedicated server from a torrent, and you're pretty much a vaporware pirate in my understanding, even if you had a legitimate copy once. (I'd love to be corrected on this).
The petition aims to have all games have a contingency plan to be released into this vaporware state if the publisher dies. Do you see how this is limiting? Do you see how a publisher can be attacked to take over their game (e.g. TF2 bot situation)? There will be cheaters everywhere, is that still "Functionally Playable State"? Seriously, watch/read summary of PirateSoftware's videos, he makes a few good points.

That some day his expensive "smart" whatever will suddenly stop working because the manufacturer killed the login server.
My tech illiterate boomer parents have a samsung tv that for some pants on head reason requires a fucking account to use. It's only a matter of time before samsung realizes what the gaming industry is getting away with and tries to copy it by killing the auth server, rendering the tv unusable.

Piracy in the EU is a case of a civil suit. You can also only sue for provable damages in lost sales. Punitive damages are not a thing in the EU. So if the rightsholders are gone, then even if it would be classified as piracy to pull in that material via a torrent, there would a) be no-one capable of bringing a case and b) there'd be no provable damages in lost sales, since the product is not for sale anymore.

I'll bite your bait. We could have virtually infinite copies of any software, but there are fags deliberately restricting what a computer can do through always-online / DRM mechanics. I don't like it when some faggot decides he's going to artificially change the nature of infinitely-reproducible software. Also, there are STATE level legal protections that prevent people from copying software infinitely. So the state is responsible for fixing at least a subset of the problem they created in the first place.

Spending power is defined by what you have available freely for spending.
Not by your gross monthly income.

How much of that $ 10,000 is being set aside for taxes, medical bills, insurances, retirement fund, etc?
How much do you have left after all that?
On a good month; and a bad month?

Hiter's so overrated on the internet, even if you agree with him.
>created a world war, that killed many of the "good guys".
>brought Germany's economy back up, only for it to be subjected by the west/Soviet Union for decades.
>Now Germany has a bunch of draconian laws about Nazism/fascism.
>holocaust/camps/whatever you want to call it, put so much money away from fighting a war on two fronts.
>helped created UN, Nato, and Israel with all he did.
Wow what a guy. What an inspiration, his legacy is ruining his own side. There was fascist all over the world, and people who agreed with him like Henry Ford. Now you have a nigger rapper who support him.

Meanwhile Russians still suck Stalin's dick/support his policies.

All the people you listed and many more would consider any video game culture to be extremely indolent and cancerous to a healthy nation. Stalin would absolutely have thrown gamers in work camps if such an activity existed at that time - he threw gamblers and drunks in labor camps, which is about as close as it gets.

>Poor euro countries (Greece, Romania): $30K
>Average euro countries (France, Germany): $50K
>Rich euro countries (Switzerland, Norway): $80K
meanwhile across the ocean

>USA, Bay Area: $250K
combine that with much heavier taxes and no such thing as tax deductibles and the average European has far less disposable income than his American counterpart.
also the gap has only widened in recent years and will continue to do so. Western Europe is slipping into 2nd world territory.

Big brands' (e.g. Sony, LG) OLED top segment at living room sizes goes at a non-trivial 2500-3500 EUR price-range though.
That's quite a lot of freely disposable income to throw away every month. Esp. if you consider that it doesn't burn a hole in the pocket yet - i.e. there's still comfortably more freely disposable income left.

Keep in mind also: Europe buys debit, not credit. They don't pay downpayments. They pay in-full, in advance.

What, like claiming devs would have to keep their game maintained forever? Or that devs would have to give up their IP? Or that we should just accept it because the ToS says so? Or that it's communism? Or that it is impossible? Or that it isn't desirable because supposedly no one cares about these games? Or that convincing all consumers to stop buying these games is a variable alternative to passing laws about it?

All these are arguments are used in every single thread. Many of them posted in the exact same way. So go ahead and talk about dishonesty, because the detractors of SKG spew little else

Yes. All GPL code, of course. Source ports and WAD files are pretty much independent, so not sure why you're asking that.
I'm talking about the choice between the legally clean FreeDOOM WAD asset files, and the original Doom/Doom2 WAD files - which are IDs IP, but one can find them freely available in a billion places. Doubt ID will stay forever cool with piracy like this.

European Court of Justice ruled as part of prejudicial hearings for Usedsoft vs Oracle that EU consumers actually buy the digital content and have ownership over their copies. Even where there is no physical carrier medium involved, they have ownership over the ephemeral bytes.

In fact, this is why platforms like Steam are legally required to still give you access to your account and purchases to install and play, when they otherwise fully ban you off of the platform.

>combine that with much heavier taxes and no such thing as tax deductibles
There's plenty of tax deductibles, actually. Notably deductibles for healthcare expenditures, home-office expenditures, etc.
Income tax rate tends to be scaled and tends to run from 10-40% where only the part of the income exceeding each scaled level's threshold is subject to that amount of taxation. The 40% isn't hit until obnoxious levels like 100,000 EUR income. Wealth tax doesn't exist in all member states. In many where it does exist, it is a figure based on what could realistically be obtained by making your money work for you via higher interest on deposit sums, stocks, etc. hovering around 1~4%.

Most EU consumers also tend to more proactively build up savings than US citizens, which are living more month-to-month on credit.
The average EU consumer has 20,000 EUR banked and saved for emergency expenditures. The average US citizen has a few hundred bucks, and that's it.

Most gamers support this idea but don't specify how it should work. They only care about the result. For a law like this to pass, it needs to be written carefully from a technical perspective, which is a challenge. Sure, some genres are easy to implement, but others are more complex. If it's adopted as it is, it could end up killing many games and genres. It'll be cheaper for companies not to make a game at all than to create an "afterlife" for it. And yeah, most gamers probably don't care about this, but I'd be sad if the industry lost future games just to keep old ones. This is basically a trade-off: we're not killing old games, but new ones.

You use your starting capital to make a purchase, instead of using it to make more money and pay for the purchase.

Not really. The EU's expenses on defense were shifted mostly to foreign aid and development programs for agriculture and healthcare in Africa. The EU could just collectively cut spending on foreign aid like the Trump administration called a halt to USAID expenses and it'd have all the defense funds it'd need.

It would cause humanitarian issues all over, but -- in a truly American take on things -- we have to look out for Number One, right?

no, games as service should have a clear indicator for when they get shut down!

This is not about keeping the game alive, that would be great if it would work but the truth is, it doesnt work. So what is needed is a date for when the support stops, or change the buy button into rent button.

No?
>You're either being intentionally dishonest or you are too flat out stupid to realise that it's its own property wholly separate from everything else. Meaning you are literally begging for someone else's property to be taken away from them.
Did Epic give away their rights to Unreal Tournament 2004?
>Let's try all of them since you can't force people to do what you want.
You can when they want to sell something. In fact, companies are already forced to do a bunch of shit if they want to legally sell a product. With your logic, devs could just release a game that literally didn't work and all would be honky dory because "you can't force people to do what you want."

Stealing is legally defined as removing a property from its rightful owner, such that they no longer have access to it.
If I get to keep a game running indefinitely because a publisher is legally forced to give me a COPY of the server software, that's not stealing.
They have the original server software still.

May I introduce you to games such as Tony Hawk's Pro Skater 5, Aliens Colonial Marines and Sonic 1 GBA. It's not uncommon for games that don't work to be released hell the 80s and 90s were flooded with them and no one expected them to be fixed with a revision because we just didn't buy them.

The process itself is legally binding once the 7 country thresholds and the 1 million votes from EU citizens have been passed. This is why only Europeans can participate since this is pretty much like voting but just on a single issue.

Do you really want a future where ANYONE can host a server for your favorite game, giving they/them access to YOUR IP and private information which they could misuse unlike legitimate and honest companies who follow string privacy guidelines?

Your property aka the file/disc associated with your license is still in your possession and it still functions as you were told the day you bought it as is described on the box. Nothing is wrong with your property.
>I get to keep a game running indefinitely because a publisher is legally forced to give me a COPY of the server software, that's not stealing
Which is appropriation of property that doesn't belong to either you or the government aka theft.
You want the government to legalise theft.

It's legally binding. I.e. if it hits 1 million, it has to be seriously considered.
There is also proper protocol for it, so it cannot be offhandedly dismissed.

A more appropriate term would be a referendum. But it's also not quite that.
I would just substitute the full term of "European Citizens Initiative" instead.
Capitalization included, since that gives it the necessary gravitas.

This is some tribal bullshit where supporters of the petition are circling the wagons and looking for a fight, since it is now ideological.

EULAs and T&Cs do not supersede the laws in any other place than america where corporations rule the land. The publisher taking away your stuff at his discretion will be purged as an option.
They are going to cope and seethe but digital ownership will eventually be on par with physical ownership.

No one is saying that they are where being said is that they contain information that is.
Being mentioned in an EULA doesn't mean you can evade copyright for example.

Yeah- it's because Xbox doesn't have the install base to hit monopoly thresholds in anti-trust legislation.
After having watched the video: this foundation is going for the Epic vs Apple play.
And Epic WON that one wrt Apple being forced to open up aspects of the platform. Even in the US. Even though Epic had screwed the pooch on violating Apple's terms and conditions for publishing on the platform beforehand.

And this is in the Netherlands.
With the Dutch.
Who tend to be *very* pro-consumer. (They are actually one of the few countries in the world with legislation that states lifetime lasting liability of the trader and manufacturer for fitness for purpose of a purchased product, let that one sink in.)

This is going to end up ... interesting.
Very VERY interesting.

Correct, and the same happens when GaaS games get cut short due to unexpected events. The expected duration here is a few years after release, a threshold all of these games under contention have reached.
So both sports leagues and game companies are already doing what they should on that front. No idea where this "explicit end date" tangent came in or why it matters.

These terms and conditions dont mean jack shit because

Is basically a Get-out clause on the side of the publisher and One-sided change to the product or service, which in turn nulls the entire document even without considering the fact you agree on it AFTER the purchase, which voids it automatically.

But in our universe, because of his ratfucking ways, people have such a visceral reaction to him that they will just sign the petition in droves, even if they don't give a shit about it at all. It will be remembered as the EU initiative with the highest amount if signatures and there will be a Wikipedia article written on it where Thor will be named as one of the chief critics of it. And he'll seethe about it endlessly.

Exactly, and they learned that's why games with DRM are dying. With less and less being released.
You, and people like you, are taking away the lessons they can learn from their mistakes so they can repeatedly buy shitty games over and over and over again.

People will still be responsible for the games they buy. It's very retarded, like saying regulations to prevent food from containing pollutant or preventing industries from dumping manufacturing waste water in rivers is only a case of people not taking responsability for their purchases to not support what the seller does.

NTA but no.
An appropriate food analogy would be buying food you know you're allergic to and then blaming the company for making it.

Yes, but it's been widely understood since the early 2000s that any game that relies on online servers is at the full mercy of the developers' choice to maintain said servers. So long as the developer does advertise otherwise, they're fine

>this. take the average gross salary of a senior software engineer, a well-paid white collar job.
>>USA as a whole: $100K
You're pulling numbers out your ass. I'm a second year software developer straight out of college, and I'm making 80K. In the Midwest. How are seniors making chump change?
Also these type of statistics are flawed because they account for too much. You even split USA into two, but we need more groups for both Europeans and US.
