Nba 2k21 was a full priced game that lasted only a year until they desided to take down the servers for that game, as a result the majority of the game no longer works.

Even the singleplayer story mode no longer works, only quick matches, and you can not save your game either.

the hole in the law comes from games being sold for a one-time fee with unclear terms (we can kill this game whenever we want for any reason), and that most companies intentionally interfere with the user's right to repair the game once it ceases functioning (we'll sue you if you host a private server and also we aren't releasing server code)

i THINK that just printing on the box "dead at some point, but you are guaranteed to be able to play it until 20XX" is not good enough to satisfy existing consumer law, but I'm not sure.

They shouldn't have it both ways: If they want a state backed monopoly, then they should be obligated to put at least a modicum of effort into enabling repairs and allowing it to be preserved in exchange for the legal rights to control how people consume and use their IP

And if they don't want that responsbility, then they shouldn't be able to bitch and moan and wield copyright laws to go after people modding the game or hacking it. Especially because, as enshrined in the US consitution, Copyright doesn't exist for creators, who have no natural rights to their own ideas or intellectual creations: Copyright, Trademarks, Patents, etc are a temporary mechanism intended to foster innovation by giving creators a monopoly on their work and profits to encourage them to make new shit, which will eventually pass into the public domain, and after it has, they'd have to make new shit again to mantain an monopolized revnue stream, and those to will pass into the public domain, eventually, etc

Plus, if they want to shut down their shit and can't sell it anyways, there is no reason they should have to mantain or keep their copyright: they're not profiting off of it and in order to incentivize them to make new shit, they shouldn't be able to even if they could

As explained by the person who founded the campaign, his intent is the second of these 3 options (and even then, he's okay with an EOL plan not necessarily meaning that the game becomes fully playable offline, and is perhaps open to merely requiring devs provide documentation or a few tools and it's up to the community to hack something together that's somewhat playable), not the first (which he agrees would be asking too much of developers), nor the third (which he thinks gives companies too much legroom to still take people's shit: he/we don't want it to merely be more obvious we own nothing and can get fucked, we want that to not be the case period)

That being said there is no actual law drafted yet so it's ultimately up to EU lawmakers for how to word it

Games with a multi-player components should be designed from the beginning to allow privately hosted multi-player servers, even if it's initially not allowed (shit like overwatch/rivals) but it would be allowed when the game is sunset. This would also prevent making public servers an issue once the game has run out of money because it was done when there was still money.

Publishers and devs should give paying customers the tools to preserve and maintain their game, the publishers and devs aren't forced to keep working on a game, simply provide the tools or make an offline mode for those who paid and bought the game, it's only fair. Regarding the EOL, publishers are iffy about this because it would force them to admit all those always-online GAASlop they keep shoveling are just a timed cashgrabs which wil inevitably get shut down, giving customers the heads up that their GAASlop only has the life expectancy of a year or two would force them to actually work on it in that timeframe and make less GAASlop as a result because it would become unprofitable.
