Apologies. I'm just used to people getting hung up on the pedantics of the literal usage of colloquialisms like that. Since you seem to be arguing in good faith, I'll return the favor.
I think the main thing differentiating our views here is that we are coming at this from different start points. I've been talking from the point when the guy actually makes the move, whereas I believe you to be speaking from the time of when it became obvious that he was going to make that stupid move.
In that case, I'd argue that while he should 100% have been expecting that idiot to make the move, and he was under no legal obligation to allow that guy in. Shitty attitude, sure, but I bet you dollars to donuts that the guy is beyond fed up with people behaving like this to him on the road, and had more of a "if you're dumb enough to make this move, I'm going to let it happen" mentality. I'm actually curious if anyone knows of, or has any followup to this incident, or knows how the courts ruled.
