There's next to nothing on PS5 that's like that that isn't published by Microsoft, Bethesda (So Microsoft), or Activision (So Microsoft), and there's even some cases like Gears of War where the actual game is on the PS5 disk anyway. Disc rot is happening for things like GC games and some PS1 games, though they generally had to have production defects like MGS Twin Snakes on GC and I believe it had to have some incorrect coating on PS1 games. The case in Australia was about Steam support reps misinforming Australian consumers about their legal right to a product free of defect and that is fit for purpose.
Basically what's called the right to a product that conforms to contract in the EU.

Steam's refund policy is a commercial alternate to the EU's right of withdrawal, which is a different legal right that applies to distance sales. It enables EU consumers to back out of any distance sale within 14 days without statement of reason. The digital media and games industries lobbied with the EU to have this right not apply to digital content because it would ruin their business models. Because they're not profiting off a copy changing hands so if they can't make money from something they originally sold to someone for their personal use then when they don't want it anymore they would probably prefer that copy stop existing. There's evidence of this in things like online passes that only entitle the first person who purchased the game brand new to get everything they're entitled to. Anyone else who gets it after them will have to pay something back to the original publisher to use it to the same degree as that person.
