As someone diagnosed with autism 20 years ago, Laios is honestly one of the most unambiguously autistic characters I have ever seen put to screen. He's like the post child for high functioning autism.
The author not intending this to be true isn't actually a good argument for against it, in the same way that an author who doesn't *intend* to write a character as an amoral psychopath can still end up doing so through carelessness. Or how in Star Trek Voyager, the writers had no particular intent behind how they wrote Captain Janeway, it was just the result of a bunch of different writers each working on their own episodes without really communicating with each other. But the end result was a character that was so wildly swinging in personality from episode to episode that the actress chose to play her has an undiagnosed bipolar, and her being mentally unstable is just an accepted fact among the fans *and the cast* despite not a single writer on the show intending it.

I see where you are coming from, but I disagree. The hyper-logical nature of those characters and the fact that they have muted expressions makes it easy to draw connections between that and autism, especially for autistic people who don't have a lot of other points of reference for 'this person is like me. I think like that.' But the fact that robots in movies were the closest things to autistic representation for decades doesn't make them *actually* autistic, and the differences there are important.
Saying that Data has autism is both technically wrong and implies false equivalencies that have real world consequences.
Technically speaking, Data is not autistic for the same reason that no non-human character can be autistic. Data's behavior is not that of a neurodivergent human, he is literally a robot. The reasons that he acts the way he does has to do with what he physically is. A real world example of this same comparison is that cats are not 'psychopaths', they are cats. Thats just how cats act. A cat doesn't need a diagnosis to behave in a way consistent with how all cats are by default, a cat having normal human psychology is what would be exceptionally weird.

As for the consequences of false equivalency, robot characters being called autistic because they are hyper-logical might be a point of overlap with IRL autistics, but other very important features of that robot package do not carry over and pretending they do only causes trouble. Data is not just hyper logical, but also bereft of emotion. He cannot feel them (outside of specific episode plots which we will ignore for now) and this is inextricable from his character. This is a common trope of such robot characters: the lack of emotion.

I'd say the difference is that when someone tries to intentionally write a character with, well any mental condition they try and hit all the checkboxes out of the DSM and make their personality all about that. Most people who've grown up with a mental illness cope with it, they change themselves to avoid standing out, act normal, try and fit in, they've had years, decades even of practice.
So when someone bases a character off themselves or someone they know who has it, diagnosed or otherwise, they write them how'd they'd actually act, not how a book says they should act. On the subject of Asperger's or whatever they are calling it now, when it comes to how a person would act, there is a world of difference between someone who is 10, 20, 30, 40 and so on because they learn what not to say, how not to carry themselves, make more eye contact, keep special interests to themselves, make small talk and so on. That is what gets portrayed in unintended characters, not just with Autism but all many of conditions and issues.
