The issue is that in that scenario you've already illustrated a willingness to break the law and conventions of society and you could be armed or seeking something else, and by letting you go I might be endangering the lives of others. Lets say for example that scenario happens but the guy was trying to rob my house and was digging through my cupboards for hidden money when I walked in.
