depends where you live, a lot of stores just throw it out if it doesnt reach a certain aesthetic appeal. Which food banks are you talking about? I've been to a few when I was really down on my luck and they had a limited supply of items, food banks also don't care to be sued so they're not going to give you past expiration date items if there is a chance of you getting sick. I'm also in the opinion that dumpster diving should be legal but the dumpster diver takes all the risks and cannot sue for expired food or getting injuried. Still the difference you talk about is tax payer vs store who is incentivized to have shiny perfect produce
