there was briefly some rumors that The Pile contained CP, and "everybody knew" but
1) everybody knowing about cp and not removing it or taking it down seems unlikely
2) the cp might have only been illegal in stricter countries (3d, drawings etc) and not illegal in the US
3) if the training data did have actual cp, and if ai cp is "fruit from a poison tree" then it means anything ai produces is a derivative work of its training data and it'd be a huge issue
but on top of all that, the law says the ai cp can't be "indistinguishable" from real cp, which stable diffusion automatically saves the instructions used to create an image, in as metadata. so all you have to do to determine if its ai or not is just look at the metadata and you can reproduce the image exactly.
